1. Introduction

Welcome to Phirke Enterprises, located at 193 MIDC Area Chikhali, Buldhana, Maharashtra – 443201, India.

These Terms & Conditions (“Terms”) govern the access and use of services, communication channels, websites, messaging platforms, and related digital services operated by Phirke Enterprises (“Company”, “we”, “us”, or “our”).

By accessing our services, communicating with us through WhatsApp Official API, RCS (Rich Communication Services), SMS, website forms, or any other digital medium, you agree to comply with and be legally bound by these Terms.

If you do not agree with these Terms, you must refrain from using our services.

2. Definitions

For the purposes of these Terms:

  • “Services” refers to all products, communication services, digital messaging services, support systems, and related offerings provided by Phirke Enterprises.

  • “Platform” refers to WhatsApp Official API, RCS Business Messaging, SMS gateways, websites, or other communication tools used.
  • “Meta” refers to Meta Platforms Inc., including WhatsApp.
  • “RCS” refers to Rich Communication Services enabled by telecom operators or Google.
  • “Content” includes text, images, documents, audio, video, branding materials, and messages.
  • “Applicable Law” refers to laws in force within India.

3. Acceptance of Terms

By accessing or using the Services of Phirke Enterprises, you confirm that:

  • You have read and understood these Terms.
  • You agree to comply with all applicable laws and regulations in India.
  • You agree to comply with Meta Business Messaging Policies and RCS Business Messaging Guidelines.

Continued use of our Services constitutes ongoing acceptance of these Terms.

4. Description of Services

Phirke Enterprises may provide business-related services including but not limited to:

  • Product sales and support
  • Customer service communication
  • Order updates and transactional notifications
  • Marketing communications (where consent is obtained)
  • WhatsApp Business messaging
  • RCS-based customer engagement

Services may evolve or change over time. We reserve the right to modify, suspend, or discontinue any service without prior notice.

5. Eligibility

To use our Services:

  • You must be at least 18 years old.
  • You must be legally capable of entering into binding contracts under Indian law.
  • If using Services on behalf of an entity, you must have legal authority to bind that entity.

We reserve the right to refuse service if eligibility requirements are not met.

6. Account Registration

Phirke Enterprises is not liable for losses resulting from unauthorized access due to user negligence.

8. Payment & Billing Terms

Where applicable:

  • Prices are quoted in Indian Rupees (INR).
  • Payments must be made through approved payment methods.
  • Invoices must be settled within the agreed timeline.
  • Late payments may incur interest or service suspension.

All taxes including GST (if applicable) shall be borne by the customer.

9. Subscription Renewal & Termination

If subscription-based services are offered:

  • Subscriptions may renew automatically unless cancelled.
  • Users may cancel by providing written notice.
  • We reserve the right to suspend or terminate services for violations.

Termination does not relieve outstanding payment obligations.

10. Use of WhatsApp Official API & RCS

Phirke Enterprises uses WhatsApp Official Business API and RCS strictly in accordance with:

  • Meta Business Messaging Policies
  • WhatsApp Commerce Policy
  • Google RCS Business Messaging Guidelines
  • TRAI regulations (India)

We only send:

  • Transactional messages
  • Service updates
  • Notifications
  • Marketing messages with explicit user opt-in

Users may opt out at any time by replying “STOP” or contacting us.

11. Message Delivery & Compliance Policy

While we strive for reliable delivery:

  • Message delivery depends on telecom operators, Meta servers, and device availability.
  • We do not guarantee uninterrupted or error-free message transmission.
  • Users must ensure their device supports WhatsApp or RCS.

We maintain strict anti-spam and consent-based communication policies.

12. Intellectual Property Rights

All content, branding, logos, text, images, and digital materials belonging to Phirke Enterprises are protected under Indian Copyright Act, 1957 and applicable intellectual property laws.

Users may not:

  • Copy or reproduce our branding.
  • Use our content without written permission.
  • Modify or distribute proprietary material.

13. Confidentiality

Any confidential information shared between users and Phirke Enterprises shall be treated with reasonable care.

Confidential information shall not be disclosed except:

14. Disclaimer of Warranties

15. Limitation of Liability

Phirke Enterprises shall not be liable for:

  • Third-party platform disruptions

Total liability shall not exceed the amount paid for the relevant service.

16. Indemnification

You agree to indemnify and hold harmless Phirke Enterprises from claims arising out of:

  • Breach of applicable laws
  • Third-party claims related to user content

17. Governing Law (India)

These Terms shall be governed by the laws of India.

Any disputes shall be subject to the jurisdiction of courts located in Maharashtra, India.

18. Changes to Terms

Phirke Enterprises reserves the right to modify these Terms at any time.

Updated Terms will be published on official platforms. Continued use after updates constitutes acceptance.
